Terms of Service

These terms are a binding agreement between you and Ebenworks Systems (Pvt) Ltd, a private company incorporated in Zimbabwe (“Ebenworks”, “we”, “us”). They govern your use of Ebenworks Accounts(accounts.ebstar.co), the central account and billing system for signing in to and managing subscriptions across Ebenworks products. By creating an account or signing in, you agree to these terms. Each individual product may have its own additional terms; where they conflict for that product, the product’s terms govern your use of it.

Your account

• You must provide accurate information and be at least 16 years old.
• You are responsible for activity under your account and for keeping your credentials secure. Tell us promptly at legal@ebstar.co if you suspect unauthorised access.
• One account gives you access to multiple Ebenworks products, each subject to its own plan and limits.

Acceptable use

You agree not to misuse the service. Prohibited conduct is set out in our Acceptable Use Policy, which forms part of these terms — in short: no unauthorised access, no interfering with or overloading the system, no using it to break the law or infringe others’ rights, and no attempting to defeat security or rate limits.

Subscriptions, billing & refunds

• Free tiers are provided as-is. Paid plans are billed through our payment providers — Stripe, Paystack or Paddle — at the prices shown at checkout. Where a plan is sold through Paddle, Paddle acts as the Merchant of Record (reseller) for that purchase and that transaction is also subject to Paddle’s buyer terms.
• Paid subscriptions renew automatically for successive periods until cancelled. You can manage or cancel a plan from your account; cancellation stops future renewals and takes effect at the end of the current period.
• Prices, taxes and plan limits may change; we’ll give reasonable notice of material changes, and price changes apply from your next renewal. Applicable taxes (e.g. VAT/sales tax) may be added at checkout.
• Refunds and cancellations are governed by our Refund & Cancellation Policy.

Termination

You may delete your account at any time from your account page. We may suspend or terminate access for breach of these terms, suspected fraud or abuse, or to comply with law. Some records may be retained as described in our Privacy Policy.

Disclaimers & liability

The service is provided “as is” and “as available”, without warranties of any kind to the maximum extent permitted by law. To the extent permitted by law, Ebenworks is not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill; and our total aggregate liability arising out of or relating to the account service is limited to the greater of (a) the amount you paid us for it in the 12 months before the claim, or (b) US$50. Nothing in these terms limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, or for fraud).

Governing law & disputes

These terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by the laws of Zimbabwe, and you and Ebenworks submit to the non-exclusive jurisdiction of the courts of Zimbabwe.

If you are a consumer, this choice of law and forum does not deprive you of the protection of any mandatory consumer-protection or data-protection laws of your country of habitual residence, and you may also be able to bring proceedings in your local courts where the law gives you that right. Nothing in these terms affects your statutory rights as a consumer.

Changes & contact

We may update these terms; material changes will be reflected by the “Last updated” date above and, where appropriate, notified to you. Continued use after a change means you accept the updated terms. Questions: legal@ebstar.co.
